The Utility of a Psychoanalytic Theory of Law

چکیده
How does psychanalytic theory inform legal theory? John Deigh's splendid book is a rare example of an attempt to bring the two together, by scholar who has made profound contributions both areas. If I shall raise some serious questions about nature rapprochement, let there be no doubt that think understanding psychoanalytic emotion major contribution, and think, as well, it offer illumination law. Focusing on “The Emotional Significance Punishment,” I'll explore this contribution (Deigh 2018, ch. 10). There are reasons for skepticism connection. Psychoanalytic descriptive our deepest drives motivations their interconnections in process human development. We not angels, contain much unsavory material: aggressive, destructive, perhaps also self-destructive. Psychoanalysts naïve way psychologists Jean Piaget Lawrence Kohlberg were, positing developmental trajectory leads inevitably toward good. Although psychoanalysts sometimes do use language “maturity” “immaturity” quasi-normatively, strictly speaking they entitled without further argument, since development great deal social intervention can often lead results normatively bad, forms selfishness narcissism analysts themselves deplore. Donald Winnicott, my own favorite thinker, uses especially liberally maturity goodness, have story tell why he language, but up us decide whether works. Insofar does, playing part normative moral well psychoanalyst. One would need very Panglossian believe natural or usual passions optimific, terms personal welfare, none leading analysts, Winnicott included, Panglossian. Furthermore, these days psychoanalysis acknowledges needs come with evolutionary commonalities we now understand between beings other primate behavior. Frans de Waal surely correct emphasizing heritage contains seeds cooperation altruism domination hierarchy, still cannot fail acknowledge latter area: chimps bonobos. Psychoanalysis gives fuller more illuminating than psychology concerning how aggression play out Still, discipline theory, reason such show angelhood. The law, contrast, resolutely normative. It must reckon likely real non-angelic beings, can't too unrealistic; its existence adversarial. lived peacefully together state nature, it. That clear. What terribly unclear, however, which law ought rely positively, repress. No passion purely good bad from point view sound order. Compassion seems helpful, know compassion parochial, binding people group separating them unlike them. whole raison d’être tax failures compassion, making give parts property satisfies publicly deliberated account welfare.
